A membership registration is required before you can utilize the full features on our sites. You may start using our service as soon as you have registered and received our confirmation email. Once you are registered, you will receive a permanent member account which can only be withdrawn through written notice to New Era.
In using our services, you agree to:
- Obey the law and not engage in or facilitate any unlawful conduct
- Obey any codes of conduct or other notices provided by New Era from time to time;
- Use the service in a legal way that will not harms us, our advertisers, affiliates, resellers, distributors and/or vendors, or any customer of ours or our advertisers, affiliates, resellers, distributors and/or vendors;
- Our services are provided on an "as-is," basis and "as available." New Era does not guarantee the accuracy or timeliness of information or replies available from the service.
- Use the services for personal uses and not damage, disable, overburden, or impair our services or interfere with other members use and enjoyment of our services; or
- Keep all direct or online communications provided by New Era such as your membership details, account management and service usage secret; and
- Notify us promptly once you learn of a security breach related to our services.
- Adhere to the copyrights and trademarks of all site content and not modify, publish, transmit or reproduce, create derivative works of, or in any way exploit any of the materials or content on our sites in whole or in part.
- Use our forum services, chat areas, communities and/or message or communication facilities only to send and receive messages and material that are proper and related to those particular facilities.
We reserve the right, without obligation, to take any of the following actions in our sole discretion at any time and for any reason without giving you any prior notice:
- Restrict, suspend, or terminate your access to all or any part of our Services;
- Change, suspend, or discontinue all or any part of our Services;
- Refuse, move, or remove any material that you submit to our sites for any reason;
- Refuse, move, or remove any content that is available on our sites;
- Deactivate or delete your accounts and all related information and files in your account;
- Establish general practices and limits concerning use of our sites.
You agree that we will not be liable to you or any third party for taking any of these actions.
You understand and agree that our Services may include communications such as announcements and administrative messages from us or from our partners and that these communications are considered part of the Services. You will not be able to opt out of receiving these messages. You also understand that our Services may include advertisements or product and services that may be of interest to you.
Membership access per account is provided solely to the owner of the account. You are responsible for all activity that takes place with your Member account. You may not authorize any commercial party to access and/or use the service on your behalf.
This section applies in all situations in which you directly pay us. If you pay a company other than us for the service, then the charges and billing terms are as stated by the other company. Even if you do not pay for the product or services and/or withdraw payment, you may still incur incidental usage charges for submitting or using the payment services.Unless otherwise provided by law or in connection with any particular service offer, all charges are non-refundable, and the costs of any returns will be at your expense.
You may be able to submit materials, reviews or feedbacks for use in connection with our Sites. You agree and understand that New Era does not control or endorse content that you and others post or provide on our Sites. You are fully responsible for any content in any form that you submit to our site. You hereby grant us, our affiliates, and our partners a worldwide, irrevocable, royalty-free, payment-free, nonexclusive, license to use, reproduce, create derivative works of, distribute, publicly perform, publicly display, transfer, transmit, distribute, and publish your submitted content and subsequent versions of your content for any purpose we deem suitable on our sites
Information is collected from you in order to operate and provide our services. We reserves all rights to access or disclose information about you, including the content of your communications, in order to: (a) comply with the law or respond to lawful requests or legal process; (b) protect the rights or property of New Era or our partners; or (c) for use to communicate to you products or services from New Era or our partners.
Personal information collected through the service may be stored and processed in the Singapore or any other country in which New Era or its affiliates, subsidiaries or agents maintain a presence. By using our services, you consent to any such transfer of information by New Era between her subsidiaries.
If we change this contract, then we will tell you at least 30 days before the change takes place. If you do not agree to these changes, then you must cancel and stop using the service before the change takes place. If you do not stop using the service, then your use of the service will continue under the changed contract.
You hereby agree to indemnify, defend and hold New Era and all of our officers, directors, owners, employees, agents, information providers, affiliates, partners, and licensors harmless from and against any and all liability, losses, costs, and expenses (including any legal fees) incurred by any New Era in connection with any claim, including, but not limited to, claims for defamation, violation of rights of publicity and/or privacy, copyright infringement, or trademark infringement arising out of usage of our site and services.
All parts of this contract are applied to the maximum extent permitted under the law.Any portion of this agreement not enforceable by law will be replaced with terms that most closely match the intent of the part that we cannot enforce. The rest of this agreement will not change. This is the entire agreement between you and New Era regarding your use of our sites and service. It supersedes any prior contract or statements regarding your use of the service. Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
Any dispute arising out of or in connection with this agreement, including any question regarding its existence, validity or termination shall be referred to and finally resolved by arbitration in Singapore in accordance with the Singapore Courts of Justices. The language of arbitration shall be English. The decision of the arbitrator shall be final.
